Garda Station Representation in Dublin
If Gardaí in Dublin have contacted you about an investigation, whether at Store Street, Pearse Street or any other station in the city, you are entitled to legal advice before any interview. You should not
attend for questioning without first speaking to a solicitor. If you have been arrested in Dublin, or asked to come in for an interview, the next few hours matter. This page explains what happens and what we do.
We attend Garda stations in Dublin at any hour. If you are reading this because someone has been taken to a station tonight, phone us now rather than reading on.
Ring us before the interview, not after
The most common thing we hear is "I thought I would explain it and it would be sorted".
It rarely works that way. What you say in a Garda interview is evidence. It is recorded, and it stays in the case from that point on. If you get the account slightly wrong under pressure, at four in the morning, having not slept, that becomes something you have to deal with later.
You are entitled to speak to a solicitor before you are questioned, and to have one with you during the interview. Ask. You do not have to give a reason, and asking does not make you look guilty.
The Dublin courts
Most serious sexual offence trials are heard in the Central Criminal Court. It sits in the Criminal Courts of Justice on Parkgate Street in Dublin 7.
The Circuit Criminal Court, in the same building, hears a good deal of sexual assault work. The District Court deals with the early stages, the first appearance after charge and bail applications.
Because the Central Criminal Court sits in Dublin, cases from all over the country end up being heard here. If your case has been sent forward for trial you may be travelling to Dublin whether you live here or not.
Dublin Garda stations
We attend across the city and the county. Store Street, Pearse Street, Kevin Street, Blanchardstown, Tallaght, Clondalkin, Ballymun, Coolock, Finglas, Lucan, Dún Laoghaire and the rest.
If you are being taken somewhere and you are not sure where, tell whoever is with you to ring us with the station name. We will find you.
What we do at the station
We find out what you are being detained for and under what power.
We speak to you privately, before any questioning starts. That conversation is confidential.
We sit in on the interview. If a question is improper, or the questioning becomes oppressive, we say so at the time.
We keep our own note of what was asked and what was answered. That note matters later, when the case is being prepared, in a way that is hard to appreciate on the night.
Do you have to answer questions?
- You do not have to answer.
- It is not quite as simple as staying silent, though.
- In certain circumstances a court can be invited to draw an inference from something you failed to mention during questioning that you later rely on in your defence.
- Whether that applies depends on the offence and on whether the proper warning was given, and how it was given.
- That is exactly why we would rather talk to you before the interview than after it.
- The right approach depends on what is actually being alleged, and you cannot work that out on your own in a custody suite.
If the Gardaí have asked you to come in voluntarily
People often ring us and say they have not been arrested, they have just been asked to come in and give their side of it.
Treat that the same way. A voluntary interview is still an interview and what you say in it can be used. Agreeing to attend does not mean you have agreed to answer questions without a solicitor there.
Talk to us before you go in.
Will this be in the papers?
It is usually the second question we are asked, and it is a fair one.
There are reporting restrictions in sexual offence cases, and the law protects the identity of complainants. The position on an accused person is not the same in every case. It depends on the charge and on the stage the case has reached.
We will tell you where you stand on that at the outset. It is a question with a real answer, not something to worry about in the dark.
Talking to us
We act for people accused of sexual offences. That is the work we do.
Phone us at any hour if someone is in a station now. If it is less urgent than that, ring or send a message and we will come back to you. What you tell us is confidential.
Frequently asked questions
Which court hears sexual offence cases in Dublin?
Most serious sexual offence trials are heard in the Central Criminal Court, which sits in the Criminal Courts of Justice on Parkgate Street, Dublin 7. The Circuit Criminal Court hears a good deal of sexual assault work. The District Court deals with the first appearance after charge and with bail.

Yes. You are entitled to speak to a solicitor before you are questioned and to have a solicitor present during the interview. You can ask at any point, including after questioning has started.
Do I have to answer Garda questions?
You do not have to answer.
